Terms & Conditions
Welcome to DESC Designs. By engaging our website design, website maintenance, social media, SEO, LLMO, or digital support services, you agree to the following Terms & Conditions. These terms are designed to ensure a clear, professional, and positive working relationship between DESC Designs and our clients.
- Project Acceptance
A project is considered accepted once written approval has been received via email, message, signed proposal, invoice payment, or acceptance of a quotation provided by DESC Designs.
- Website Design & Development
DESC Designs provides custom website design and digital services tailored to each client’s business goals and requirements.
Project timelines vary depending on the size and complexity of the website, client response times, and availability of required content and materials.
Estimated timeframes provided are guides only and may change during the course of the project.
- Client Responsibilities
To ensure projects run smoothly and within agreed timelines, clients are responsible for providing:
- Website content, images, logos, and branding materials
- Required login details and access permissions
- Feedback and approvals within reasonable timeframes
- Accurate business information and contact details
Delays in providing content or approvals may affect project timelines.
- Design Approval & Revision Policy
DESC Designs works closely with clients throughout the design process to ensure satisfaction with the website’s style, layout, and branding direction.
Package inclusions may include a specified number of design revisions. Once the website design, layout, and colour palette have been approved, any substantial changes or additional revisions requested beyond this point may incur additional charges.
Any additional work outside the original project scope will be quoted separately.
- Payment Terms
Starter Website Package (1-Page Website)
Full payment is required upfront before work commences.
All Other Website Packages
Payments are divided into the following stages:
- 50% deposit before the project begins
- 30% upon design approval
- Final 20% payment prior to website launch
Websites will not be launched, transferred, or released publicly until full payment has been received.
DESC Designs reserves the right to pause work on projects with overdue invoices.
- Pricing & Quotations
All pricing is provided in Australian Dollars (AUD) with GST added unless otherwise stated.
Website package pricing, maintenance plans, and service rates may change without prior notice.
Custom quotes are valid for 30 days unless otherwise specified.
- Urgent & Expedited Projects
Projects requiring a fast-tracked turnaround timeframe of approximately 2–3 weeks may incur a 25% priority service surcharge.
Availability for urgent projects is subject to DESC Designs’ current workload and scheduling capacity.
- Website Hosting & Domains
Clients remain the legal owner of their domain names, hosting accounts, and related services.
Where hosting setup assistance is provided through providers such as Conetix, clients will receive direct access to their hosting portal and billing information.
DESC Designs does not access or manage client billing information unless specifically requested.
Hosting, domain renewals, and third-party services remain the responsibility of the client unless otherwise agreed in writing.
- Website Maintenance & Support
Website maintenance packages (12 months from start of project) includes:
- Plugin and theme updates
- Website backups
- Security monitoring
- Technical support
Unless specifically included in a maintenance package, content updates and website edits may incur additional charges.
DESC Designs is not responsible for issues caused by third-party plugin updates, hosting outages, or changes made by external parties.
- SEO & LLMO Services
DESC Designs provides SEO (Search Engine Optimisation) and LLMO (Large Language Model Optimisation) services designed to improve website visibility across search engines and AI-driven platforms.
While best practices are followed, DESC Designs cannot guarantee specific rankings, traffic levels, leads, or search engine placements due to factors outside our control.
- Social Media Services
Clients are responsible for supplying approved images, branding materials, and content information unless otherwise included in their package.
DESC Designs reserves the right to decline publishing content considered offensive, misleading, unlawful, or inappropriate.
- Website Content & Intellectual Property
Clients retain ownership of all content, logos, and materials supplied to DESC Designs.
DESC Designs retains ownership of custom design concepts, graphics, layouts, and development work until final payment has been received in full.
Upon final payment, ownership of the completed website design transfers to the client, excluding third-party licensed materials, themes, plugins, fonts, or software.
- Portfolio Rights
DESC Designs reserves the right to display completed projects within our portfolio, website, social media platforms, and marketing materials unless otherwise agreed in writing.
- Limitation of Liability
DESC Designs will not be held liable for:
- Loss of business, profits, or data
- Website downtime caused by third-party services
- Cybersecurity breaches outside reasonable control
- Issues caused by client modifications or third-party software
- Cancellation Policy
If a project is cancelled after work has commenced, payments made up to that point are non-refundable.
Any completed work, development time, or additional services performed beyond paid amounts may be invoiced accordingly.
- Acceptance of Terms
By engaging services with DESC Designs, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
